TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of 123JusChill.com (the “Site”) and purchases from Jus Chill International, LLC, doing business as Jus Chill (“Jus Chill,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility and Acceptable Use

You must be legally able to enter into a binding agreement to use the Site or make a purchase. You may use the Site only for lawful, personal, and noncommercial purposes. You may not interfere with the Site, attempt unauthorized access, introduce malicious code, scrape content without permission, impersonate another person, or use the Site in a way that violates law or another person’s rights.

2. Products and Availability

We sell food products, including Jamaican breadfruit snacks and baking mixes. Product availability, packaging, ingredients, sizes, and descriptions may change. We make reasonable efforts to display products accurately, but colors and packaging may appear differently on a screen. We may limit quantities, discontinue products, or refuse or cancel an order when reasonably necessary.

3. Orders, Prices, and Payment

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or ship the product. Prices, promotions, shipping charges, and applicable taxes are shown at checkout and may change before purchase. You agree to provide accurate billing, shipping, and contact information and authorize our payment processor to charge the payment method you provide. If a pricing or availability error affects an order, we may contact you, correct the order with your approval, or cancel and refund it.

4. Shipping and Delivery

Shipping options, costs, and estimated delivery times are shown at checkout when available. Delivery dates are estimates and may be affected by carriers, customs, weather, incorrect addresses, or events outside our reasonable control. You are responsible for providing a complete delivery address and for any duties or import charges imposed by the destination country. Contact us promptly if an order is lost, damaged, delayed, or delivered incorrectly.

5. Returns, Refunds, and Order Problems

Because we sell food, opened or used products may not be returnable for food-safety reasons except where required by law. If your order arrives damaged, defective, or incorrect, contact us promptly through 123JusChill.com/take-action and include your order number and, when helpful, photographs of the product and packaging. Return, replacement, cancellation, and refund requests are reviewed based on the circumstances and applicable law. Nothing in these Terms limits rights that cannot legally be waived.

6. Food, Ingredients, and Allergen Information

Read the product label before consuming or preparing any product. Packaging provides the most current ingredient, allergen, net-weight, preparation, and storage information. If you have a food allergy, dietary restriction, or question about a product, contact us before purchase or consumption. Site content is general information and is not medical or nutritional advice.

7. Accounts and Communications

If account features are available, you are responsible for protecting your credentials and for activity under your account. You agree to notify us of suspected unauthorized use. Transactional messages may be sent about orders, deliveries, support requests, or important service changes. Promotional messages are subject to your choices and applicable law.

8. Intellectual Property

The Site and its text, images, graphics, logos, product names, layout, and other content are owned by or licensed to Jus Chill and are protected by intellectual-property laws. You may view and use the Site for personal purposes, but you may not copy, modify, distribute, sell, or create derivative works from Site content without prior written permission, except as allowed by law.

9. Reviews and Other Submissions

If you submit a review, message, photograph, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting our business, subject to our Privacy Policy. We may remove submissions that violate these Terms.

10. Third-Party Services and Links

The Site may use or link to third-party services, including payment, shipping, social-media, and analytics providers. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control.

11. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not guarantee that the Site will always be uninterrupted, error-free, secure, or suitable for every purpose. Product warranties, if any, will be stated with the product or required by applicable law. These disclaimers do not exclude warranties or protections that cannot legally be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, Jus Chill and its owners, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Site or a purchase. Our total liability for a claim relating to an order will not exceed the amount paid for that order, unless applicable law requires otherwise. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold Jus Chill harmless from claims, losses, or expenses arising from your unlawful misuse of the Site, violation of these Terms, or infringement of another person’s rights.

14. Suspension and Termination

We may suspend or end access to the Site when we reasonably believe a user has violated these Terms, harmed the Site or another person, or created legal or security risk. Provisions that by their nature should continue after termination will remain in effect.

15. Governing Rules and Consumer Rights

These Terms are governed by the laws applicable to Jus Chill’s operations, without overriding mandatory consumer protections that apply where you live. Before beginning formal proceedings, you and Jus Chill agree to try in good faith to resolve a dispute by contacting one another. This section does not prevent either party from seeking urgent relief or using rights that cannot be waived.

16. Changes, Severability, and Entire Agreement

We may update these Terms to reflect changes in our business, Site, products, or legal obligations. The revised version will be posted with a new effective date. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any terms shown at checkout, form the agreement governing your use of the Site and purchases.
